The current owner befriended me one day when she saw me galloping along the beach on my horse to the Chiringuito beach bar La Sal.  She walked her dog down to me and introduced herself and asked whether she could come riding with me one day.  She did and we have become firm friends ever since either horse riding together or playing tennis at La Duquesa Golf Club

They use their duplex penthouse apartment as a holiday home and stay in it four or five times a year.  Apart from the exceptional aspect and beautiful Moorish design of the property, they love the fact that the urbanisation La Perla de la Bahia is so well managed – the gardens and pools (one heated in winter) beautifully maintained and security guards present 24 hours a day.  I know it is secure as when I visited it to take these photos I set the alarm off and within minutes someone was there!

    Landlord’s rights have changed

    Many property owners in our areas of Duquesa, Manilva and Casares Costa have bought their properties as investments and as such open their properties to long term rental tenants. Importantly for those landlords there has been a recent amendment to the Civil Precedural Law that involves important changes to the eviction process.

    The new eviction process involves the Court sending a notice to the defendant giving a 10 DAY period to either pay the outstanding rent or vacate the property or defend the claim. If the defendant (tenant) has not replied within this 10 DAY period or has not settled the debt within the 10 DAY period,  the Court will declare the property eviction without a Court trial. If the defendant decides to challenge the claim, a court trial will be held.

    This change also allows the claim to be made through a small claim proceeding which is a much faster process.

    Capital gains Tax in Spain

    This is a tax on the profit that a seller may have made when selling their property and is calculated taking into account the difference between the original purchase price paid and the selling price achieved.  The Capital Gains Tax in Spain is calculated as follows:

    19% for the 1st €6000 profit & 21% for any amount above this.

    The capital gains tax is often a point of confusion for vendors and depending on the seller’s tax status in Spain, the Capital gains Tax must be paid in varying ways.

     Non Tax Residents (none fiscal residents.)

     The buyer (or the buyer’s Lawyer) is obliged by law to retain 3% of the selling price and to pay it to the Inland Revenue on behalf of the vendor.  If profit is not achieved by the vendor they have a right to claim back the 3% and should be refunded within 12 months.

    If a profit has been made but the amount is less than the 3% Capital Gains tax paid, then a claim for a refund can also be made.

     Tax Residents (Fiscal Residents)

     There is no 3% retention made by the buyer.

    It is the seller’s responsibility to declare and pay the Capital Gains Tax, if any, the year after completing the sale and when filing their annual Income Tax Returns.

    The only time that Capital Gains tax does not have to be paid on the sale of a property is if the seller is a Fiscal Resident of Spain, is over 65 years old and if the property being sold is their primary residence.

    What is Plusvalia Tax?

    We are often asked questions by our vendors regarding the costs involved in selling a property in the Manilva area and it is a very important point of consideration.

    One tax that will be levied with the property seller in called the Plusvalia Tax. This is a tax on the increase of value of the land from when the seller took ownership. It is the local town hall that calculates the Plusvalia Tax and the final amount is determined by the location of the property NOT the market value.  In the case of our Vendors it will be Manilva or Casares Town Hall and Barrington Homes recommend that when you are considering selling your property you visit your legal representative for an estimation of the Plusvalia Tax. Barrington Homes have a calculator available to our vendors to enable them to estimate their costs and on this we have averaged the Plusvalia tax at €2000 although it can be more or less. The Lawyer acting in the sale will make retentions at the point of exchange to cover the Plusvalia tax.
