Landlord’s rights have changed

Many property owners in our areas of Duquesa, Manilva and Casares Costa have bought their properties as investments and as such open their properties to long term rental tenants. Importantly for those landlords there has been a recent amendment to the Civil Precedural Law that involves important changes to the eviction process.

The new eviction process involves the Court sending a notice to the defendant giving a 10 DAY period to either pay the outstanding rent or vacate the property or defend the claim. If the defendant (tenant) has not replied within this 10 DAY period or has not settled the debt within the 10 DAY period,  the Court will declare the property eviction without a Court trial. If the defendant decides to challenge the claim, a court trial will be held.

This change also allows the claim to be made through a small claim proceeding which is a much faster process.
